Terms of Service

1. Acceptance of Terms

By accessing or using VoxyDent ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including clinic administrators and staff members.

2. Description of Service

VoxyDent provides an AI-powered voice receptionist platform designed for dental clinics. The Service includes:

  • Automated answering of incoming patient phone calls using conversational AI.
  • Appointment scheduling and management through voice interactions.
  • Call recording, transcription, and summary generation.
  • A web-based dashboard for managing appointments, reviewing calls, and configuring your voice assistant.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Notifying us immediately of any unauthorized use of your account.
  • Ensuring that the clinic information you provide (name, address, operating hours, dentist details) is accurate and kept up to date.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these terms. You may not:

  • Use the Service for any purpose other than operating a dental clinic's voice receptionist.
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service.
  • Interfere with or disrupt the Service or its infrastructure.
  • Use the Service to transmit harmful, offensive, or illegal content.
  • Resell, sublicense, or redistribute access to the Service without our written consent.

5. Subscription and Billing

The Service operates on a subscription basis. By subscribing, you agree to the following:

  • Subscription fees are billed on a recurring basis (monthly or annually, depending on your selected plan).
  • Payments are processed securely through Stripe. You authorize us to charge your payment method on file for all applicable fees.
  • Prices may change with at least 30 days' notice before the start of your next billing cycle.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
  • Refunds are provided at our discretion and in accordance with applicable law.

6. Call Recording and Data Processing

By using the Service, you acknowledge and agree that:

  • Incoming phone calls handled by the AI assistant will be recorded and transcribed.
  • You are responsible for ensuring compliance with local laws regarding call recording and patient consent in your jurisdiction.
  • Call recordings and transcriptions are processed to extract appointment details and provide call summaries.
  • Voice data is processed by third-party AI providers as described in our Privacy Policy.

7. Intellectual Property

The Service, including its software, design, branding, and documentation, is owned by VoxyDent and protected by intellectual property laws. You retain ownership of all data you provide to the Service (clinic information, call recordings, appointment data).

You grant us a limited license to use your data solely for the purpose of providing and improving the Service.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible).
  • Unplanned outages caused by circumstances beyond our reasonable control.
  • Third-party service disruptions (telephony, AI processing, payment providers).

We are not liable for any losses resulting from Service unavailability.

9. Limitation of Liability

To the maximum extent permitted by applicable law, VoxyDent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Termination

Either party may terminate this agreement at any time:

  • By you: Cancel your subscription through the dashboard or by contacting us. Your access will continue until the end of your current billing period.
  • By us: We may suspend or terminate your account if you violate these terms, fail to pay applicable fees, or if required by law.

Upon termination, you may request an export of your data within 30 days. After this period, your data will be deleted in accordance with our Privacy Policy.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Zagreb, Croatia.

12. Changes to These Terms

We reserve the right to modify these terms at any time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised terms.
